Designation of legal representatives

Article 13 of the DSA requires providers of intermediary services, which do not have an establishment in the European Union (‘EU’), but which offer services in the EU, to designate in writing a legal representative in one of the Member States where their services are offered. The legal representative may be a legal or natural person.

Coimisiún na Meán is responsible for receiving designations of legal representatives that reside or are established in Ireland.

Designations must be issued by the provider of intermediary services on their company letterhead and must be signed by a suitably authorised person.

The designation letter must include the following information:

  • the company name of the provider of intermediary services;
  • details of incorporation of the provider of intermediary services (country of incorporation and company number);
  • the name of the legal representative designated for the purpose of Article 13 of the DSA and details of incorporation (if applicable);
  • the legal representative’s contact details (contact name, email address, postal address and telephone number); and
  • an explicit statement by the provider of intermediary services that the legal representative has been designated for the purpose of Article 13 of the DSA.

It would assist us and the provider of intermediary services, if the provider of intermediary services provides their principal web address (URL) at the same time. This will ensure fast and accurate identification of the provider of intermediary services’ online presence.

Providers of intermediary services are obliged to ensure that the information is publicly available, easily accessible, accurate and kept up to date.
