Online Platform and Search Engine Services
Coimisiún na Meán (“An Coimisiún”) has published a list of larger online platform and online search engine services whose providers have their main establishment or legal representative in Ireland.
The online platform and online search engine services included on this list and their providers are subject to the obligations set out in the Regulation (EU) 2022/2065 of the European Parliament and of the Council of 19 October 2022 on a Single Market for Digital Services and amending Directive 2000/31/EC (the “DSA”) and are regulated by us in our role as the Digital Services Coordinator.
Certain providers of these online platform and online search engine services are subject to the 2026 levy, pursuant to section 21 of the Broadcasting Act 2009, as amended. Further information about the 2026 levy can be found on our Levy Order page.
It is important to note that there may be other online platform and online search engine services that fall within An Coimisiún’s competence that are not included in the list below, for example smaller or newer services. Additional services may be included or removed, as appropriate. The list will be updated accordingly.
For the avoidance of doubt, if a service is not included on this list, it should not be taken that they are not subject to the obligations set out in the DSA, nor that they do not fall under the remit of An Coimisiún.
Notes:
- Coimisiún na Meán is designated, as of 17 February 2024, as the Digital Services Coordinator for Ireland for the purposes of Article 49 of the DSA.
- Coimisiún na Meán is responsible for the supervision and enforcement of the DSA in Ireland to comprise all intermediary services i.e. online search engines, online platforms, hosting services, caching services, mere conduits regardless of size. - Article 3(i) of the DSA states that an ‘online platform’ means a hosting service that, at the request of a recipient of the service, stores and disseminates information to the public, unless that activity is a minor and purely ancillary feature of another service or a minor functionality of the principal service and, for objective and technical reasons, cannot be used without that other service, and the integration of the feature or functionality into the other service is not a means to circumvent the applicability of the DSA.
- Article 3(j) of the DSA states that an ‘online search engine’ means an intermediary service that allows users to input queries in order to perform searches of, in principle, all websites, or all websites in a particular language, on the basis of a query on any subject in the form of a keyword, voice request, phrase or other input, and returns results in any format in which information related to the requested content can be found.
